First of all a notice is to be sent to the builder claiming a refund of amounts paid along with interest or damages. If that doesn't work, a regular suit can be filed in the competent court for specific performance of the contract. One can also file a case before consumer redressal forum against the builder for deficiency in service.

I(Franchisee) contacted a Franchisor for setting up a school at a particular location a year back. We have paid them 5 lakhs upfront for finding a rented place and help setting up the school. We did not sign any franchise agreement with them so far. We have an email which says that if they cannot find a place or setup the school in a year they would refund the money in full. Its been more than a year and we still did not setup a school. The team who we were dealing with are no longer with the Franchisor and now the management team is not honouring the email and they are willing to give only some amount as refund.
