Yes the cheque can be deposited a second time provided it is within 3 months time after issue of the cheque as you are getting fresh cause of action after presenting the cheque, provided the legal notice is issued, which is statutory within 30 days of receipt of the memo from the bank which will state "insufficient funds" . It is crucial not miss the the 30 days time limit as the cause of action will be lost, if the money still is not paid then a 138 case for cheque dishonour is to be filed.
